About the theme

For too long, the Indian criminal justice system has worked more for the file than for the people, prioritizing procedural formalities over substantive justice. The theme for Volume 8 Issue 1 is “Decoding India’s New Criminal Codes.” The enactment of the Bharatiya Nyaya Sanhita (BNS), 2023, the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, and the Bharatiya Sakshya Adhiniyam (BSA), 2023 marks a watershed moment in India’s legal history, replacing colonial-era statutes with a modernized criminal justice framework.

While the codification of these laws represents a significant legislative overhaul, their true test lies in implementation, how effectively they translate from statute books into practical judicial and policing reforms. This theme seeks to critically examine the transition from theory to practice, exploring challenges such as institutional readiness, technological adaptation, and judicial interpretation.
